I think you mean 10th birthday. on Jan 3, 2010, bitcoin's genesis block was mined. Not Jan 3, 2009.
What a moral question indeed! If I was offered the 100 BTC, I would take it in a heartbeat and just tell myself that it was from some whale that didn't even know it was gone…..(chances are that it's from some old dear's pension is pretty unlikely given how damn hard it is to understand buying it!)
